Another strategic move by the Huangpu River, contributing to high-quality development in the city of Shanghai. On the afternoon of August 22, 2023, Blossom & Credit successfully held the Theme Forum on Hot Legal Issues in Corporate Compliance under the New Development Structure and the Opening Ceremony of Beijing Blossom & Credit (Shanghai) Law Firm ("Blossom & Credit Shanghai") Branch in Renaissance Shanghai Zhongshan Park Hotel. Over 200 guests attended the event, including representatives from competent authorities, industry associations, experts, client representatives, partners and attorney representatives from Blossom & Credit and its various branches to witness the inauguration of a new chapter for Blossom & Credit Shanghai Branch. Mr. LI Weiming, Executive Director of Blossom & Credit Shanghai Branch, presided over the forum.

At the beginning of the forum, Mr. LI Yinwu, Managing Partner of Blossom & Credit Law Firm ("Blossom & Credit"), delivered the opening speech and introduced the development history, services, and operation philosophy of Blossom & Credit to the attending guests. He highlighted that for the past two decades, Blossom & Credit has remained focused on providing commercial legal services as its main business direction. With the impetus of meeting the growing legal service demands of clients, Blossom & Credit has gradually transitioned into a more comprehensive business model. Following this, Mr. LIN Ziyue, Secretary of the Party Committee and Director General of the Shanghai Municipal Changning District Justice Bureau, Mr. DU Yu, Dean of the Fudan University Law School, Ms. FAN Hong, Secretary General of the Shanghai Foreign Investment Association, and Ms. XIE Chunyuan, Director of Fujifilm Business Innovation (China) Corp., delivered speeches consecutively for the forum. Subsequently, Mr. DU Yu, Ms. FAN Hong, Ms. XIE Chunyuan, along with Mr. PENG Youyi, Director of Blossom & Credit, Mr. WU Changsheng, Founder of Credit Attorney Service Team, and Mr. FU Jing, Executive Director of the Blossom & Credit Chengdu Branch, jointly pressed the activation button for Blossom & Credit Shanghai Branch. Together with the attendees, they extended their best wishes for Blossom & Credit's new chapter of development in Shanghai.

Mr. LIN Ziyue warmly welcomed Blossom & Credit's entry into the Shanghai attorney community. Mr. LIN emphasized that attorneys are an important force in the socialist legal construction with Chinese characteristics. In recent years, Blossom & Credit has closely followed the policy guidance from the superstructures and progressively introduced legal service products focusing on corporate compliance. These offerings provide comprehensive legal support for compliance management to clients across various sectors, including state-owned enterprises, foreign-funded enterprises, publicly listed companies, and private enterprises. This assistance aids businesses in preventing, identifying, evaluating, and addressing compliance risks, ensuring their smooth and steady development.


During the theme-sharing session titled "Hot Legal Issues in Corporate Compliance under the New Development Structure", five senior attorneys organized by Blossom & Credit Shanghai Branch each presented insights based on their practical experiences. Mr. ZHOU Yue highlighted the compliance risks related to digital transformation in areas such as combating unfair competition, personal data protection, safeguarding trade secrets, and managing electronic contracts, and presented corresponding solutions; Ms. WEI Jie delved into internal corporate fraud and anti-fraud measures, outlining the fundamental process and considerations for anti-fraud investigations; Mr. GAO Yadong analyzed the evolving trends in the field of commercial disputes, discussed the emerging demands related to non-litigation approaches and the integration of conservatory measures in case handling, elaborated on the key aspects of non-litigation negotiations and highlighted the necessity of implementing conservatory measures; Ms. JI Zhaochun provided a detailed breakdown of considerations for enterprise operations from three dimensions: pre-investment, during investment, and post-investment, with a focus on foreign investment; Mr. WU Kun centered his presentation around the six key elements - purpose, subject, duration, scope, actions, and amounts, particularly emphasizing the strategies for addressing matters ranging from non-compete dispute resolution to safeguarding a company's trade secrets.

They engaged in lively discussions and shared insights on hot legal issues in corporate compliance.

From the perspective of intellectual property compliance protection, Ms. FU Ye shared practical solutions ranging from statements and correspondence to administrative measures. She underscored the significance of legal risk management in safeguarding intellectual property rights. Addressing compliance system establishment, Ms. REN Di noted that amidst the new development structure, the constant factor for compliance professionals remains the control of risks and the ultimate goal of ensuring the smooth operation of business entities. The variable aspect lies in adapting proactively and flexibly to different policy contexts and legal environments.

Mr. WANG Tingyu introduced the process and methods of implementing compliance concepts in state-owned enterprises, emphasizing the aspects of building systems, refining regulations, clarifying responsibilities, improving processes, and cultivating culture. Regarding data compliance issues, Ms. SHENG Qinfen mentioned the high sensitivity of data. In pharmaceutical research and development companies, it's often necessary to navigate compliance risks by adopting an "usable but not visible" approach. Establishing strong data compliance, data protection awareness, and regulations help enterprises better engage in project research and development.
